Niture reserves the right to determine the eligibility of any warranty claim and to decide whether a defective part should be repaired or replaced.
If a replacement is required under this warranty and the defective material or model has been discontinued or is unavailable, Niture reserves the right to substitute a similar item of equal value. Otherwise, the same product or material will be provided for replacement.
This warranty is valid only for the original purchaser and is non-transferable. Benefits conferred by this warranty cannot be assigned or extended to others.
If a replacement part is required during the warranty period:
To the fullest extent allowed by law, Niture shall not be responsible for any indirect or consequential losses arising from or related to the purchase, use, or inability to use any Niture product.
Niture’s total liability, whether arising in contract, tort (including negligence), or otherwise, shall not exceed the actual amount paid by the customer for the product that gave rise to the claim.
